This policy applies whenever a person visits Mens Health Clinics, uses this website, contacts the clinic by phone, WhatsApp or email, schedules an appointment, attends a consultation, purchases a product or otherwise receives a service from Mens Health Clinics. Mens Health Clinics is a natural-medicine and herbal consultancy specialising in men’s sexual wellness. Mens Health Clinics is not a hospital or conventional medical practice. A consultant should not be understood to be a medical practitioner. The clinic’s services are complementary and do not replace diagnosis, prescribed treatment, emergency care or advice from an appropriately registered healthcare professional.

2. Individualised natural-medicine consultations

Mens Health Clinics does not use a one-size-fits-all approach. During a consultation, recommendations may be considered according to the client’s age, current symptoms, overall health, medical history, medicines and supplements being used, lifestyle, personal goals, contraindications and other relevant individual circumstances. Clients should provide complete and accurate information during a consultation. A consultation is strongly recommended before starting any product or programme because an option that may be appropriate for one person may be unsuitable for another.

3. Services and areas of support

Areas in which Mens Health Clinics may provide consultation, general information and complementary wellness support include:

5. Personal information we may collect

Depending on how a person interacts with Mens Health Clinics, the clinic may collect:

• Transaction information: consultation, order, delivery and payment-related records. Full payment-card information may be processed directly by an authorised payment provider rather than stored by Mens Health Clinics.

Mens Health Clinics aims to collect information directly from the person concerned. If information is received from another lawful source, it will be handled in accordance with POPIA and this policy.

6. Why personal information is processed

Mens Health Clinics may process personal information for the following purposes:

• Providing an individualised consultation and related recommendations

• Processing transactions and maintaining appropriate business records

Health information is special personal information under POPIA. Where consent is the lawful basis, Mens Health Clinics will request consent that is voluntary, specific and informed. A person may withdraw consent, although this does not affect processing that was lawful before the withdrawal.

10. How long information is kept

Retention periods may differ according to the type of information and the reason it is held. Mens Health Clinics may need to verify the requester’s identity before providing access to, correcting or deleting information.

13. Adults only and capacity to consent

The website, consultations, products and services of Mens Health Clinics are intended for adults aged 18 years and older who are able to give informed consent. Mens Health Clinics does not knowingly offer these services to, or intentionally collect personal information from, persons under 18 without a lawful basis and the involvement of an appropriate competent person. 14. Consultations, customised products, returns and refunds

Consultation fees relate to the professional time and service provided. A consultation that has already taken place is generally not refundable merely because the client’s preferred outcome was not achieved. For health, hygiene and safety reasons, products that have been opened, used, consumed or customised for an individual may not be eligible for exchange or return. Cancellation, dispatch, delivery and refund requests will be assessed according to the circumstances, the condition and nature of the goods or services, and the Consumer Protection Act, 2008 and other applicable South African law. Nothing in this policy removes any consumer right or remedy that cannot lawfully be excluded. Defective, unsafe, incorrectly supplied or misdescribed goods and services will be handled in accordance with applicable law. 15. Limitation of responsibility

Clients remain responsible for supplying accurate information, following instructions, disclosing allergies, health conditions and current medicines, and seeking appropriate medical care when needed. Mens Health Clinics is not responsible for harm caused by information that a client withheld, misuse of a product, failure to follow instructions, use contrary to professional advice, or reliance on general website information instead of obtaining an appropriate individual assessment, to the extent permitted by law. To the fullest extent permitted by applicable law, Mens Health Clinics will not be liable for indirect, incidental or consequential loss arising from use of the website or services. Nothing in this policy excludes or limits liability where exclusion or limitation is prohibited by law, including liability that cannot lawfully be excluded under consumer-protection legislation.

16. Acknowledgement and consent

By using the website, contacting Mens Health Clinics, scheduling an appointment or receiving a service, a person acknowledges that this privacy policy has been made available to them. Where POPIA or another law requires consent for a particular activity, Mens Health Clinics will request that consent separately or through an appropriate notice or process. Scheduling an appointment does not amount to unlimited consent for every possible use of personal information. Clients should ask for clarification before proceeding if they do not understand any part of this policy, a proposed product, a consultation recommendation or the applicable fees and terms.
